The Karnataka Administrative Tribunal (KAT) has issued stay order on the suspension order issued against K.M. Dharamappa, Deputy Commissioner, Mysore City Corporation (MCC) in its order passed on February 11, 2013. It may be mentioned that Dharmappa was recently suspended from duty by the Department of Urban Development accusing him of tampering his date of birth.
Dharmappa had approached the KAT soon after his suspension order was issued on February 4, 2013. The tribunal observed that the date of birth, that is, 28-11-1953 mentioned in the service register and seniority list announced on 9-7-2011 matched and instead questioned the Urban Development Department as to why the matter was not noticed earlier. The tribunal has also put on hold for three months the order passed to recover salary paid to Dharamappa from December 2011.
It is said that Dharmappa had sought for VRS on 29-7-2011 but for some reasons the VRS application was not accepted and he continued to work at Mysore City Corporation. But, suddenly on February 4, 2013 an order from Urban Development Authority came as shocker and that is when he decided to knock the doors of KAT. This apart, according to Karnataka Civil Service Rules the names of government officers/employees retiring in that particular year has to be announced 12-18 months prior to their retirement. Prima facie evidence shows that Dharmappa had no role to play in tampering the date of birth, said the order passed by KAT.
